Austin K. Kurtz


Austin defends plaintiff’s rights in personal injury and wrongful death claims, as well as advises on a variety of business litigation matters.

Austin is skilled in managing major cases from start to finish. A 2021 Super Lawyers Rising Star, Austin recently served as first chair in a trail involving a complex wrongful death lawsuit, which he handled from intake all the way through a favorable settlement on the third day of trial.

Representative Cases

  • First-chaired wrongful death case against the State of Arizona, obtained 7-figure settlement mid-trial.
  • Successfully second-chaired personal injury lawsuit for burn case against a private country club, receiving a $640,000 verdict.
  • Assisted in negotiating and drafting multiple settlement agreements totaling over $10 million.
  • Lead counsel representing limited partner in limited liability limited partnership in convoluted multi-million-dollar probate matter.  Forced general partner to sell partnership property; reviewed bank statements and discovered discrepancies leading to a larger recovery; and negotiated dissolution of partnership agreement.

Representative Experience

  • Worked all types of commercial cases including anti-terror, real estate theft, and multi-million-dollar Ponzi-scheme frauds.
  • Successfully litigated life insurance malpractice case as lead counsel.
  • First-chaired summary jury trial on product liability/ negligence case.
