REPRESENTATIVE EXPERIENCE

  • Obtained $1,375,000 settlement for the family of a young man killed in a motorcycle crash.

In a motorcycle wrongful death case involving a single adult male, Ty Taber and Jonathan Litster secured a $1,325,000 settlement from the first-party insurance carrier and full policy limits of $50,000 from the at-fault driver. We successfully argued against the insurer’s attempt to limit recovery under Arizona’s anti-stacking statute (A.R.S. § 20-259.01(H)), which would have limited the family’s recovery to $250,000  under their Underinsured Motorist (UIM) coverage. Ty and Jonathan found that multiple vehicles and policies were available, and proved that the insurer’s policies and client notices did not comply with the statute. On behalf of the grieving family, Ty and Jonathan recovered an additional $1,025,000—more than triple the initial offer—for a total settlement of $1,375,000.
